1. Introduction

The website at marvolous.co.za and the online shop at shop.marvolous.co.za are operated by Marvolous Creams.

By using the website, creating an account or placing an order, you agree to these Terms & Conditions. If you do not agree, please do not use the website or place an order.

3. Eligibility and customer information

You must provide accurate, complete and current contact, delivery and billing information when placing an order or creating an account.

You are responsible for keeping your account login details secure and for activity that takes place under your account where this results from your failure to protect those details.

4. Products and product information

Marvolous aims to provide accurate descriptions, photographs and product information. Colours and product appearance may vary slightly because of:

• Lighting
• Photography
• Screen settings
• Natural variation in handmade products
• Small-batch production

These natural or display variations do not mean that materially inaccurate or misleading descriptions are acceptable.

Product packaging, labels or ingredients may occasionally be updated. Please read the product label, ingredient information, usage directions and warnings before use.

5. Handmade and natural variation

Marvolous products may be handmade or produced in small batches. Minor differences in colour, consistency, scent or appearance may occur without affecting normal product use or quality.

This clause does not remove or limit your consumer rights relating to defective, unsafe or incorrectly supplied goods.

6. Pricing

All prices are displayed in South African Rand (ZAR).

Prices are displayed in South African Rand and include any applicable taxes where required.

Marvolous may update prices, promotions and product availability from time to time. The price confirmed during checkout applies to your order, subject to correction of genuine and obvious errors.

7. Orders

An order is submitted when checkout is completed. An automated order confirmation confirms receipt of the order but does not necessarily mean that the order has been accepted or dispatched.

Marvolous may decline or cancel an order where:

• A product is unavailable
• Payment cannot be verified
• Customer information is incomplete
• There is an obvious pricing or technical error
• The order appears fraudulent or unlawful

If Marvolous cancels a paid order, you will be refunded using the appropriate payment process.

8. Payment

Payments are processed securely through PayFast. Marvolous does not directly store complete card details entered into PayFast.

Orders will only be processed once payment has been successfully confirmed. Payment-processing delays outside Marvolous’s direct control may occasionally occur.

9. Order processing

Orders, cancellations and approved refunds are normally processed within two business days.

“Processing” means preparing the order, cancellation or refund request. It does not mean that a parcel will necessarily be delivered within two business days.

Orders placed after business hours, over weekends or on public holidays begin processing on the next business day.

Delivery choices, fees and estimated timeframes are presented during checkout. You are responsible for selecting the correct PUDO Locker and providing accurate contact information.

11. Collection from PUDO Locker

You must collect your parcel within the collection period communicated by PUDO or the delivery provider.

You are responsible for using the collection PIN, OTP or instructions securely.

Where lawful and reasonable, additional charges caused by an uncollected, rejected or incorrectly addressed parcel may be charged to you.

Nothing in these Terms & Conditions removes rights provided by applicable South African consumer law.

13. Product use, allergies and sensitivities

Products must be used according to their labels and instructions. Please review the ingredient list before use.

Where appropriate, perform a patch test before using a new topical product. If you have known allergies, sensitivities, medical conditions or concerns, seek suitable professional advice before use.

Marvolous products are intended for personal care and everyday use. We do not state or imply that our products diagnose, treat or cure medical conditions unless an individual product is legally approved and specifically described that way.

14. Intellectual property

The Marvolous name, branding, photographs, graphics, copy and website content may not be copied, reproduced or commercially used without written permission, except where allowed by law.

15. Website availability

The website may occasionally be unavailable because of maintenance, technical problems or services outside Marvolous’s control.

16. Third-party services

The website and online shop may use services such as:

• PayFast for payment processing
• PUDO for locker delivery
• Website hosting
• WooCommerce for the online store
• Email providers
• Security or other operational tools where enabled

17. Limitation of liability

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited under South African law, including liability for death or personal injury caused by negligence where such exclusion is not permitted, or for fraud.

To the extent permitted by law, Marvolous will not be liable for indirect loss resulting from misuse of products, failure to follow product instructions, or events reasonably outside its control.

18. Governing law

These terms are governed by the laws of the Republic of South Africa.
